INFORMATION CLAUSE FOR VISITORS TO FACEBOOK FANPAGE

The information contained below has been written for Facebook Users, and in particular for fans of the Administrator’s fanpage, in order to provide information on the collection of personal data, the reasons for its processing and the rights they have.

PERSONAL DATA ADMINISTRATOR

As the creator of the fanpage WSEI University in Lublin ul. Projektowa 4, 20-209 Lublin, entered in the Register of Non-Public Higher Education Institutions kept by the Ministry of Education and Science under no. 196, NIP 712-26-52-693, REGON: 432260703 (hereinafter: Administrator) is the administrator of personal data of individuals, which, in particular, is the following:

  • have subscribed to the fanpage by clicking the “Like”, “Observe” or “Share” icon
  • have published a comment, under any of the posts posted on the fanpage,
  • addressed correspondence to the Administrator via Messenger;
  • provided their data within the framework of the so-called “contact advertising” (Facebook Leads Ads).

The second administrator of personal data is Meta Platforms which owns the social networking site Facebook.

PERSONAL DATA SECURITY

The administrator of the fanpage takes measures to secure personal data to the greatest extent possible.

The administrator uses appropriate data protection mechanisms, trains employees and associates, monitors publicly available information to search for improvements in the security of personal data, and has implemented mechanisms to respond quickly and efficiently to alarming signals regarding the possibility of a breach of personal data protection. However, the main measures regarding the protection of personal data processed within the Facebook social network are taken by Meta Platforms.

PERSONAL DATA PROCESSING

Any action taken by the Administrator on the fanpage shall be in accordance with the requirements of Facebook’s rules and regulations.

The Administrator’s fanpage policy may differ in content from other entities’ Facebook pages.

All messages and photos as well as information disclosed by registered Users on the Administrator’s fanpage and their activity on the social network are directly administered by Facebook.

The Administrator processes personal data provided via the fanpage only for the purpose of answering Users’ questions, commenting on posts and communicating with Users as part of the Administrator’s activities and content provided by the Administrator, as well as marketing activities.

Users’ activity related to the use of the Administrator’s fanpage will not be archived by the Administrator outside Facebook.

The Administrator has no control over what data is collected by the provider of social networking plug-ins or pages and how it is processed.

TYPES, PURPOSES AND LEGAL GROUNDS FOR PERSONAL DATA PROCESSING

Through the operation of the fanpage, the Administrator collects and processes the following types of personal data:

  • Facebook identifier (usually including first and last name, which is not verified by the Administrator in any way to confirm the veracity of the data);
  • basic identification data in the scope published by the User on his/her own profile on the Facebook social network;
  • other data in the scope published by the User on his/her own profile on the Facebook social network;
  • profile photo (thanks to it, in some cases, the Administrator can learn the User’s image);
  • other photos (which may also depict an image) resulting from the fanpage – User relationship. Placing photos under the Administrator’s posts is voluntary;
  • the content of User’s comments and the content of the conversation carried out through the Messenger application (thanks to it the Administrator can learn about the User’s e-mail address, his/her phone number in connection with the circumstances of correspondence addressed to the Administrator).

Users’ data are processed by the Administrator for the following purposes and on the following legal bases:

  • for the purpose of running a fanpage on the Facebook social network, under the terms and conditions specified by Facebook Inc. and informing through it about its activity, promoting the brand, services, organized events and building and maintaining the community associated with it, as well as for the purpose of communication through available Facebook functionalities (comments, chat, messages). The legal basis for such processing is the Administrator’s legitimate interest (Article 6(1)(f) GDPR);
  • for analytical purposes concerning analysis of the functioning, popularity, use of the fanpage. The legal basis for such processing is the Administrator’s legitimate interest (Article 6(1)(f) GDPR);
  • For the purpose of possible defense against claims. The legal basis for such processing is the legitimate interest of the Administrator (Article 6(1)(f) GDPR);
  • in order to carry out marketing activities – the Facebook Leads Ads system used by the Administrator may involve the processing of personal data. The data that the Administrator obtains and the purpose of collecting this data each time derives from the content and function of the ad in question. The legal basis for such processing is the User’s consent (Article 6(1)(a) GDPR). Consent can be withdrawn at any time, which does not affect the processing of data that took place before its withdrawal.
  • The User’s personal data may also be processed on the basis of a separately granted consent to the extent and for the purpose specified in the content of the consent and for the time until the consent is withdrawn – the legal basis for processing is the consent of the data subject (Article 6(1)(a) GDPR).

DATA RECIPIENTS

The Administrator may share Users’ data with the following categories of entities:

  • public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for the purposes arising from generally applicable laws;
  • other entities which, on the basis of relevant data processing outsourcing agreements signed with the Administrator, may process personal data on behalf of the Administrator, e.g. companies providing fanpage IT services; companies providing marketing services,
  • to the owner of the social networking site Facebook on the basis of the data rules set out by Meta Platforms consistent with the: https://www.facebook.com/privacy/explanation

TRANSFER OF DATA TO THIRD COUNTRIES (OUTSIDE THE EEA)

The Administrator does not transfer Users’ data outside the European Economic Area, subject to the transnational nature of data flow within Facebook. Meta Platforms may transfer User data outside the European Economic Area.

KEEPING STATISTICS AND PROVIDING ADVERTISEMENTS

The Administrator keeps statistics to optimize the content delivered to his fanpage. For this purpose, it uses statistics tools provided within the Facebook social network and revealing the behavior of Users. The information provided in this way is anonymized and does not allow for the identification of Users.

FACEBOOK ADS

The Administrator may use the Facebook Ads tool, which allows targeting ads to designated target groups, but it does not give the Administrator the ability to identify Users.

DATA STORAGE PERIOD

Users’ data will be processed for the period necessary for the purposes of the processing indicated above, i.e.:

  • information about Users that the Administrator has in private messages will be kept for the duration of the Administrator’s response to Users’ inquiries or until the termination of the cooperation;
  • in the case of information that the Administrator has in the comments shared by Users, it will be available on the Administrator’s fanpage until the author deletes it;
  • Users’ personal data collected by Facebook, i.e. history of posts, history of activity in the Messenger application, history of activity through the Instagram application is subject to retention under the terms of Facebook’s regulations;
  • data processed on the basis of consent will be processed until the consent is withdrawn,
  • data processed on the basis of the Administrator’s legitimate interest will be processed until an objection is effectively made or the interest ceases to exist.

RIGHTS OF DATA SUBJECTS

The data subject has the right to access the content of his/her personal data, the right to obtain a copy of the personal data subject to processing, the right to rectify, request erasure, as well as the right to restrict processing, the right to data portability, the right to object to the processing of personal data.

You have the right to object to the processing of your personal data if:

  • the processing of personal data is carried out on the basis of a legitimate interest or a task carried out in the public interest or in the exercise of public authority, and the objection is justified by the particular situation in which the User finds himself, or
  • the personal data is processed for the purposes of direct marketing, including profiling, to the extent that the processing is related to such direct marketing.
  • If the legal basis for the processing of personal data is the consent you have given, you have the right to withdraw your consent at any time, without affecting the legality of the processing performed on the basis of consent before its withdrawal.

PROFILING

The Administrator may automatically tailor certain content to the needs of Users and persons who have provided their data via the fanpage who have consented to the processing of their personal data, i.e. perform profiling, using the personal data they have provided.

The profiling consists primarily in the automatic assessment of what products these persons may be interested in, based on their previous activities on the Internet, including through the fanpage, and the display of advertisements of products profiled in this way.

Profiling, carried out by the Administrator, does not result in decisions that produce specific legal effects on those persons or affect them in a similarly significant manner. 

THE VOLUNTARINESS OF PROVIDING DATA AND THE CONSEQUENCES OF NOT DOING SO

Provision of data is voluntary, but the consequence of failing to provide data will be the inability to use the full functionality of the fanpage, such as leaving comments.

COOKIES
